European Union Trademark renewal

This article will describe the procedure for the renewal of European Union trademark registration. European Union trademark registration is administered by the European Union Intellectual Property Office (EUIPO), located in Alicante, Spain. Registration of an European Union trademark (Community trademark) before the European Union Intellectual Property Office (EUIPO) is the best and easiest way for protection of trademarks in the European Union. When the mark is successfully registered, the protection is spread on the territory of all member states of the European Union. The owner of the European Union trademark (Community trademark or European trademark) has the right to use it not only on the territory of one member state of the European Union, but also on the territory of the whole union.

The European Union trademark registration is valid 10/ten/years from the filing date of the application for registration in the European Union Intellectual Property Office (EUIPO). Registration may be renewed indefinitely for further periods of 10 / ten / years. The request for renewal shall be submitted in the six-month period prior to the expiry of the registration or within six months after the expiry of that period, against payment of a higher state fee. The request for renewal shall include the registration number of the EU trademark to be renewed and data identifying the proprietor and shall be accompanied by a document certifying payment of the prescribed fee payable to EUIPO. Regulation (EU) 2015/2424 provides an opportunity the registration of the mark to be renewed for only some of the goods or services for which the mark is registered.

Once the requirements of Regulation (EU) 2015/2424 are fulfilled, the registration of the mark shall be renewed and the renewal shall take effect as of the day following the expiry date of the preceding registration. The renewal shall be registered.

Recommendation: Trademark owners are advised to submit a request for renewal of the registration of the European Union trademark in the last year before the expiration of the ten year period, because after that the owner will have only six months for the renewal of the registration and has to pay a higher state fee. In case the deadline for renewal is missed and the trademark owner wants to continue to have exclusive rights to the trademark, a new application for registration shall be filed. 

A single request for renewal may be submitted for two or more marks, upon payment of the required fees for each of the marks, provided that the proprietors or the representatives are the same in each case.

What are the fees payable to EUIPO for renewal of European Union trademark registration?

I. Fees payable to EUIPO for renewal of registrations and publication until expiration of the registration term of validity:

  • for one class of goods and services – 850 Euro (1500 Euro for collective and certification marks);
  • for the second class of goods and services – 50 Euro (50 Euro for collective and certification marks);
  • for each class of goods and services exceeding two – 150 Euro (150 Euro for collective and certification marks).

II. Fees payable to EUIPO for renewal of registrations and publication up to 6 months after the expiration of the registration term of validity.

Additional fee for the late submission of the request for renewal: 25 % of the belated renewal fee, subject to a maximum of EUR 1 500.
