NATIONAL DESIGNS

According to Article 3, paragraph 1 of the Bulgarian Industrial Design Act, the design is the visible appearance of a product or part of it, defined by the peculiarities of the form, lines, contours, ornaments, color or combination of them.

COMMUNITY DESIGNS

Registration of industrial design before the European Union Intellectual Property Office (EUIPO), located in Alicante, Spain, is the best and easiest way for the protection of designs in the European Union. When the design is successfully registered, the protection is spread on the territory of all member states of the European Union. The owner of the Community design has the right to use it not only on the territory of one member state of the European Union but also on the territory of the whole union. The registration procedure is facilitated by filing one application, payment of one fee and the Community design is examined and registered within days of a correctly-filed application. Multiple-design applications are allowed.

INTERNATIONAL DESIGNS – HAGUE SYSTEM OF REGISTRATION. REPRESENTATION BEFORE THE WORLD INTELLECTUAL PROPERTY ORGANIZATION (WIPO)

International design registration is administered by the International Bureau of the World Intellectual Property Organization (WIPO), located in Geneva, Switzerland. The Hague Agreement establishes an international registration system, which allows design owners to obtain protection for their industrial designs in countries that are parties to the agreement through filing one single international application. The Hague system has facilitated the registration process by having a single filing as well as permitting the applicant to hire a single attorney (who speaks one of the languages: English, French or Spanish), who can be located in the home country of the applicant.
