Krasimira Kadieva’s article is published in the June Bulletin of the European Communities Trade Mark Association (ECTA)

Krasimira Kadieva contributed to the June edition of the ECTA Bulletin, with an article titled: “Acquired distinctiveness of trademarks through use under Bulgarian Law”.

In the article, Kadieva Kadieva examines Bulgarian legislation on proving acquired distinctiveness of a trademark as a result of use. Acquired distinctiveness allows a sign that is initially descriptive or devoid of distinctive character to be registered as a trademark when, as a result of its use, consumers begin to perceive it as an indication of commercial origin. The applicant must prove acquired distinctiveness for the specific goods or services through clear and convincing evidence of market share, duration and territorial scope of use, advertising investments and recognition among the relevant consumers in Bulgaria.

The publication reflects Attorney Kadieva’s extensive professional experience in the field of trademark law – a field she defines as both her professional passion and daily practice.
