A law on the provision of digital content and digital services and on the sale of goods will guarantee consumers a higher degree of protection during online shopping

On March 19, 2021, a new Law on Provision of Digital Content and Digital Services and on Sale of Goods was promulgated, which will enter into force on January 1, 2022. It introduces the provisions of Directive (EC) 2019/770 on contracts for the provision of digital content and digital services, as well as Directive (EC) 2019/771 on contracts for the sale of goods.

The new Law on Provision of Digital Content and Digital Services and on Sale of Goods aims to significantly increase consumer protection, as until now there was no legal framework governing the provision of digital content and digital services, respectively the rules for the sale of goods laid down in the Consumer Protection Act did not cover goods containing digital elements (such as robot vacuum cleaners, goods with a software control system, etc.). The new Law provides for a number of benefits for the protection of consumer rights, such as a two-year warranty period, which takes effect upon receipt of the goods by the consumer, and personalized pricing of the goods. At the same time, traders are obliged to provide clear information when reducing the price of goods.
