In August and September 2019, a client, with whom we have worked on various projects over the last two years contacted us. The client provided us two-word marks in order to conduct a preliminary trademark search as he wishes to register a European Union trademark for food supplements, which are goods that fall within Class 5 of the Nice Classification of Goods and Services. After conducting the preliminary trademark search, it appeared that against one of the provided marks there is a risk to be opposed because we identified several earlier marks that were similar and registered for identical goods in class 5. We prepared a written legal opinion containing the results and an analysis of the results found which we provided to the client.
