In December 2018, a client contacted us and hired us to conduct a preliminary trademark search for a combinative trademark he wishes to register. On the basis of the results of the preliminary search, we drafted an exhaustive written analysis in which we analyzed the possible risks. The results showed that the trademark would successfully pass the examination on absolute grounds for refusal, no identical and/ or similar trademarks were found and the only identified risk was the application of Art. 26, para. 3, item 6 of the Law on Marks and Geographical Indications, where the grounds for the invalidation of the registration of a trademark are regulated. The detailed written analysis we have prepared was provided to the client within the agreed period.
