In December 2018, we were contacted by a client who provided us with three-word marks and asked us to conduct a preliminary search to determine whether the marks could be registered as European Union trademarks before the EUIPO. After conducting the preliminary search for all of the three trademarks, it turned out that the client is advised not to register any of the three marks proposed because similar earlier marks have been found and it is possible oppositions to be filed within the provided three-month period. We prepared a written legal opinion describing the results of the preliminary search and advising the client not to file an application for registration. We also provided the client detailed information about the earlier similar trademarks that have been identified during the preliminary search.
