In November 2018 we were contacted by a client who assigned us to perform a preliminary trademark search for a word trademark with effect on the territory of the Republic of Bulgaria for Classes 36 and 37 of the Nice Classification of Goods and Services for the purpose of a registration of a trademark. Our client intends to develop the trademark only on the territory of the Republic of Bulgaria so we had to check whether there are registered similar earlier trademarks with effect on the territory of the Republic of Bulgaria. After conducting the search in the databases it turned out that there are three earlier trademarks that have an effect on the territory of the Republic of Bulgaria and are registered for services in Classes 36 and 37 of the International Classification of Goods and Services. After carrying out a more detailed search we found evidence of use for one of the trademarks. We drafted a written report and provided the results to the client advising him not to develop this trademark because it is likely to be a subject of opposition from a proprietor of one of the earlier trademarks or if the trademark is successfully registered to be later invalidated.
