In June 2018, we were contacted by a client who hired us to perform a search for a word trademark for services in Class 35 of the Nice Classification of Goods and Services. We conducted the preliminary search and prepared a written analysis containing the results of the search. In the first place, during the search, we have identified that the trademark is descriptive and indicative and therefore is devoid of any distinctive character and falls within the scope of Article 11 of the Trademarks and Geographical Indications Act, which norm regulates the absolute grounds for refusal. For that matter, we have advised the client not to develop this trademark or if he decides to do so to add a distinctive figurative element to the trademark to become eligible for registration, but in this way the client will have the exclusive right only on the sign as it is registered and another competitor may register a trademark containing the word element but with another figurative element, which is why we have recommended the client not to develop that trademark. In addition, several trademarks containing the word element were found in the database and registered for identical services in Class 35 of the Nice Classification of Goods and Services.
