In May 2016, a client, who intends to develop a fashion brand assigned us to conduct a preliminary trademark search of a wordmark for goods – clothes that are classified in Class 25 of the Nice Classification of Goods and Services. Our client intends to register a trademark of the European Union. Following the search we performed, it turned out that there was a similar European Union trademark for the production of identical goods, which at the time of the search was used in the commercial activities. We have provided the results of the preliminary trademark search to our client and advised not to register this trademark because there is a high possibility an opposition to be submitted as there is a high degree of similarity between the two trademarks.
