In December 2018 we were contacted by a client who received a letter from German attorneys hired by a German website owner. In the letter sent to our client, it is stated that our client allegedly infringed the copyright of photography by a photographer – a client of the owner of the German website. The letter provided a period in which the use of the photograph to be suspended and also a claim for pecuniary and non-pecuniary damage. After we became acquainted with the document sent to the client it turned out that there is no violation of intellectual property rights, since according to art. 24, para 1, item 7 of the Copyright and Related Rights Act the landscape photographs, taken in an urban environment are not subject to copyright in Bulgaria. In recent months, we have consulted several clients who have contacted us in connection with identical cases, all of whom have received letters from the same law firm.
