In June 2016, a milk and dairy products producer contacted us and provided us with a combinative trademark consisting of a word and figurative element. The client hired us to conduct a preliminary trademark search for the territory of the Republic of Bulgaria for goods in Class 29 of the Nice Classification of Goods and Services. After having performed the search in the databases, it turned out that there is a similar trademark to the trademark provided by the client and is registered as a national trademark which means that it has an effect on the territory of the Republic of Bulgaria and it is for identical goods in Class 29 of the Nice Classification. The earlier trademark is used on the territory of the Republic of Bulgaria. We described the results in an analysis that we provided to the client and advised him not to develop the trademark for which we conducted a search as it would violate earlier rights, and the proprietor of the earlier trademark has the right to oppose the use in the commercial activity of a similar trademark.
