In March 2018, we were contacted by a food manufacturer client with whom we had previously worked on several projects and commissioned us to perform a trademark search of a combinative trademark. The combinative trademark consists of a word element and a figurative element, in which case the word element is at the same time a dominant and distinctive element in the composition of the mark. Our client intends to register the mark as a European Union trademark for goods in Classes 5, 29 and 30 of the Nice Classification. We conducted a preliminary trademark search in the databases containing filed for registration and registered trademarks and did not find any earlier similar and/or identical trademarks for similar goods. Furthermore, the trademark is sufficiently distinctive and will pass the expertise on absolute grounds for refusal. We have prepared a written statement and the client has instructed us to proceed with the filing of a European Union trademark application. We filled out the application for registration of the trademark and submitted it electronically by paying in due time the fees to the EUIPO. In about two weeks, the mark passed the expertise on absolute grounds for refusal and was published in the official bulletin of the EUIPO. No oppositions and objections were filed in the timeframe (3 months) and the mark was registered within four months of the filing of the application for registration. We provided the client with the certificate for registration, with which we successfully completed the registration process.
