We have drafted Terms and Conditions for the Use of a website for provision of distance financial services

In June 2018, a client who provides distance financial services contacted us and assigned us to prepare Terms and Conditions for the use of a website for distance provision of financial services which would be published on the client’s website. The Terms and Conditions for the use of a website should contain information that is specified in the Distance Financial Services Act. In compliance with the imperative requirements set in the Distance Financial Services Act, we prepared comprehensive Terms and Conditions which have been approved by the client and contain all the necessary information to be provided to the Users. The Terms and Conditions we have drafted have the following structure, namely:

  • Introduction;
  • Objectives and scope of the Terms and Conditions;
  • Identification of the Provider;
  • Service: – nature and characteristics of the service; – types of services; – the price of the service and the validity of the information provided; – subject matter of the service and terms of service provision; – service provision order; – method of payment and execution of the service ;
  • Concluding an agreement: – signing an agreement; – right of withdrawal of the User from the concluded agreement and Terms and Conditions for exercising the right of withdrawal; – termination;
  • Rights and Obligations of Users;
  • Rights and Obligations of the Provider;
  • Processing of personal data;
  • Liability;
  • Links to third-party websites;
  • Intellectual property rights. Restriction on use;
  • Final provisions.
