In April 2018, we were contacted by a client who had previously worked with us on several different projects and provided us with three-word trademarks to check if they violate earlier rights. Our client intends to trade goods outside of the territory of the Republic of Bulgaria, for which he wants to develop and register a European Union trademark. Our trademark search covers the territories of all member states of the European Union (28 countries). The services for which the trademark will be applied for registration fall within Class 35 of the Nice Classification of Goods and Services. We conducted a preliminary trademark search of all three-word marks that were provided to us and we have drafted a detailed written legal opinion containing an analysis of the results from the search. It turned out that it is not advisable to develop any of the proposed trademarks because they violate earlier rights of proprietors of similar trademarks and there is a risk of oppositions to be filed if an application for registration of one of the trademarks is filed.
