On February 1, 2017, a workshop on “Negotiating a trademark coexistence agreement” was held, which was organized by The Association of European Trade Mark Owners MARQUES and Madara Law in City Hotel in Sofia. During the workshop, special attention was paid to the specific legal issues related to the trademark coexistence agreements as well as case studies were presented and discussed. The participants were divided into two teams in the last part of the workshop. They were given a case study that had to be solved through the negotiation of a trademark coexistence agreement.
A trademark coexistence agreement is an agreement by two or more persons that similar marks can coexist without any likelihood of confusion; allows the parties to set rules by which the marks can peacefully coexist.
